Terms of use

This is a translation for your convenience. If there is any discrepancy, the Spanish version prevails.

These terms govern the use of Railcoon, a service provided by Luis Miguel Colorado Pérez, with NIF (Spanish tax ID) 32705389X and address at Travesía Centeás 8, 15350 Cariño (A Coruña), Spain (hereinafter, "Railcoon", "we"). By creating an account you accept them. If you do not agree, do not use the service.

1. What Railcoon is and what it is not

Railcoon is a recording and calculation tool for private groups of poker players. It lets you record staking deals (selling and buying a percentage of tournaments and packs), percentage swaps (swaps), results and settlements, and it works out how much each person has to pay or receive based on the data entered by users.

Railcoon is not:

  • A gambling operator. It does not organise tournaments or games, does not accept bets, does not offer prizes and is not linked to any poker room.
  • A payment institution or a financial intermediary. It does not receive, hold, transfer or guarantee anyone's money. All payments are made directly between users, outside Railcoon, by whatever means they agree. A payment showing as "paid" or "confirmed" in Railcoon only reflects what the users have indicated.
  • A party to the deals between users. The deals recorded in Railcoon are private agreements between the people who make them.
  • An adviser. Nothing in Railcoon is financial, tax, legal or investment advice.

The service is free. If in the future we offer paid features, we will tell you beforehand and they will only apply if you accept them.

2. Requirements for using Railcoon

  • Being 18 or over.
  • The gambling and the deals you record being legal where you are.
  • Providing true information and keeping a single personal account. You may not create accounts on behalf of another person or transfer your account to anyone.
  • Keeping your password secure. You are responsible for what is done with your account; if you think someone has accessed it, change your password and let us know.

3. Groups

  • Railcoon works through private groups. Whoever creates a group is its owner and can appoint admins.
  • The owner and admins manage their group under their own responsibility: they decide who joins, can remove or pause members and, within the limits set by the app, mark debts as paid, close or correct results and cancel deals. Their actions are recorded in the group log, which nobody can edit or delete.
  • Railcoon does not supervise the activity of groups and is not responsible for the decisions of their owners and admins.

4. Deals between users

When you buy or sell a percentage, make a swap or settle a result, the deal is between you and the other person. Accordingly:

  1. Each user is responsible for honouring what they agree, for paying what they owe and for the data they enter (percentages, buy-ins, prizes, results) being true.
  2. Railcoon does not guarantee the identity, solvency, honesty or performance of any user, nor that the results reported are correct.
  3. Calculations depend on the data entered. Check the amounts before paying or confirming a payment.
  4. Railcoon's records are for information only. They are not proof of payment or an acknowledgement of debt, although you can use them as supporting evidence. Keep your own proof (bank transfers, Bizum, screenshots…).
  5. Railcoon does not refund or advance any amounts, and is not liable for amounts a user fails to pay.

5. Disagreements between users

  • Disagreements are resolved between the people involved, with help from their group's admins if needed, using the tools in the app (requesting the cancellation of a swap, marking a dispute, sending a payment reminder…).
  • The "I disagree" button and messages to support help us review possible abuse of the platform. We are not arbitrators or mediators, we are not obliged to resolve the disagreement or to decide who is right, and our decision, if any, does not oblige the parties to pay or to stop paying anything.
  • We may, at our discretion and proportionately, suspend accounts, remove content or correct manifestly wrong data where there are signs of fraud, abuse or breach of these terms. A suspended account can still log in to pay and settle anything outstanding.
  • The above does not limit your right to go to court or to use other legal routes against the other party.

6. Your legal obligations

You are solely responsible for:

  • Complying with the gambling regulations where you are, including, in Spain, Law 13/2011 on the regulation of gambling, and for playing only with authorised operators.
  • Complying with the terms of the poker rooms where you play. Some prohibit or restrict staking, account sharing or someone else playing for you. Railcoon is not linked to any poker room and does not check those terms.
  • Declaring your winnings and losses to the tax authorities where applicable. Railcoon does not file tax returns, does not withhold tax and does not report to the authorities on your behalf, unless required by law.
  • Not using Railcoon with money of unlawful origin or for money laundering or the financing of unlawful activities.

7. Prohibited uses

You may not use Railcoon to:

  • Deceive or defraud other users: false results, purchases you do not intend to pay for, fake or duplicate accounts, impersonating another person…
  • Organise or promote unauthorised gambling, or advertise gambling operators, bonuses or affiliate schemes.
  • Offer financial or payment services, or charge other users commissions through the platform.
  • Publish content that is unlawful, offensive or discriminatory, that infringes third-party rights, or that includes other people's personal data without their permission.
  • Harass, threaten or pressure other users, including in order to collect a debt.
  • Access other people's data or accounts without permission, scrape data, overload the service or try to get around its limits or security measures.

8. User content

  • You are responsible for what you publish: username, photo, description, payment methods, tournament names, comments and ratings.
  • You grant us a free, non-exclusive licence to host that content and show it to the appropriate people within Railcoon, solely to provide the service and for as long as you keep it published.
  • Ratings must be honest and relate to real deals. We may remove content that breaches these terms or the law.

9. Service availability

  • Railcoon is provided as is and as available. We do our best to make it work well and without interruptions, but there may be errors, downtime for maintenance or provider failures.
  • We may change, extend or withdraw features. If we decide to shut down the service, we will give you at least 30 days' notice so you can save what you need.

10. Liability

  • We are not liable for deals between users, for payments made or not made, for gambling losses or for decisions you make based on information in Railcoon.
  • Nor are we liable for damage caused by use of the service contrary to these terms, by content published by other users or by causes beyond our reasonable control.
  • Nothing in the above limits our liability where the law does not allow it to be limited, in particular for wilful misconduct or gross negligence, nor the rights granted to you by consumer protection law.

11. Suspension and account closure

  • You can delete your account whenever you like from Settings, provided you have no pending payments or open deals. Deleting it erases your data and your history, including for the people you had deals with (see the Privacy policy).
  • We may suspend or close an account that breaches these terms or the law. Except in serious or urgent cases, we will explain why.

12. Responsible gambling

Railcoon does not let you gamble, but we know it is used around gambling. Only play with money you can afford to lose and do not chase your losses. If gambling stops being fun, get help: in Spain you can consult the resources of the Directorate General for the Regulation of Gambling (www.ordenacionjuego.es) and register with the General Register of Gambling Access Bans (RGIAJ).

13. Changes to these terms

We may update these terms to adapt them to legal changes or changes to the service. If the change is significant, we will notify you at least 15 days in advance in the app or by email, and we will ask you to accept it again. If you do not agree, you can delete your account.

14. Governing law and courts

These terms are governed by Spanish law. If you are a consumer, the courts of your domicile will have jurisdiction; otherwise, the courts of the judicial district of the owner's domicile (Ortigueira, A Coruña).
